Professor Shayak Sarkar and Professor Gabriel (Jack) Chin to speak about immigration in the School of Law Summer Faculty Workshops. These are the following workshops:

  • July 18 – Holly Cooper: “The History and Current State of The Flores Settlement Agreement”
  • July 25 – Shayak Sarkar: “The Financial Regulation of Immigration”
    This presentation explores how agencies, authorities, and enterprises that appear, at first blush, to be unrelated to immigration regulation nonetheless create regulatory frameworks that meaningfully impact undocumented immigrants’ financial lives.  As states engage in these arenas with immigration-related intent, whether to support or inhibit undocumented immigrants, these regimes raise novel preemption and federalism questions.  In intervening on broader immigration preemption debates by exploring the interaction of finance and immigration, this Article also argues for an acknowledgement of competing deferences, including to state and local tax policy, and of the technical constitutional questions arising from long-term residency- and employment-based state financial benefits for undocumented immigrants.  This Article also proposes a revived consideration of state intent, as opposed to just Congressional or federal intent, in preemption analysis.
  • August 1 – Jack Chin: "A Nation of White Immigrants: State and Federal Racial Preferences Among Noncitizens"
    Professor Chin will be discussing his paper which explores the ways in which states and the federal government used immigration and naturalization classifications to discriminate on the basis of race among noncitizens in domestic, non-immigration contexts, such as employment, civil rights, licensing, and property ownership.
  • August 8 – Afra Afsharipour: “The Political Economy of India's Corporate Governance Reforms”
